FILMING IN VENEZUELA

Requirements:

According to Article 40 of the National Cinematography Law, shooting permits should be required for foreign films entirely or partially produced in Venezuela, and is granted only after completing the following steps, in application of Article 57 of Presidential Decree  N° 1612 dated 4/09/92:

  1.  Screenplay.
  2. Artistic and Technical Union membership cards.
  3. Copies of Business Visas, issued by the Consular Office
  4. Registration of Copyright.
  5. Production budget for Venezuela.
  6. Authorization from the Ministry of Education - Office of Tribal Affairs, if the shooting location is in declared Native (tribal) Zone.  These areas are restricted to scientific and anthropological projects, and documentaries for scientific diffusion.
  7. Authorization from the Direction of National Parks of INPARQUES, if the shooting location is in declared National Parks or Reserved Zones.
  8. Foreign producer authorization for his/her representative in Venezuela.

  10. The CNAC is enable to give information on the conditions and permits required in Venezuela for any kind of filming as well to canalize all international petitions with local institutions and producers.

 

REMARKS:

  • It is recommended to hire an Agent in Venezuela in order to make all the necessary arrangements for the forwarding proceeding in such business.
  • To take the filming equipment to Venezuela, the film company must legalize at the Consular Office a letter describing its features and time planned to be in the country. This letter should be notarized and stamped with the Apostille from the Ministry of Foreign Affairs.   

 IMPLEMENTATION OF THE ‘APOSTILLE’ CONVENTION
Since March 16, 1999 the Bolivarian Republic of Venezuela is part of the Hague Convention of October 5, 1961 abolishing the requirement of legalization of foreign public documents.

The Government of India has signed the Hague Convention and the Ministry of External Affairs, Government of India, at CPV Division, Patiala House, has started issuing APOSTILLES w.e.f. August 29, 2007.

APOSTILLE stickers will be issued on the following documents:
Personals:

  1. birth,
  2. death,
  3. affidavits,
  4. power of attorneys,
  5. marriage etc

Educational:

  1. degree,
  2. diplomas,
  3. matriculation
  4. secondary level certificates.

The convention does not imply that documents do not need to be legalize, they should be stamped with the Apostille by the Ministry of External Affairs (MEA). 

However, commercial documents, are excluded from the purview of the Convention.

Procedure: All documents should be first authenticated by the designated agencies in the State from where the document has been issued. In case of personal documents, Home Department/General Administration Department are the designated authorities. In case of educational documents, State Governments have now opened Regional Authentication Centers (RACs) at various States from where the document should first be attested. Documents attested by these authorities then need to be presented to MEA for issue of Apostilles.

Fee: A fee of Rs. 50/- in form of Postal/Pay Order drawn in favour of PAO, MEA, New Delhi is payable for each Apostille sticker.
